BPLog Terms of Use
1. Introduction
- These Terms of Use (the "Terms") set out the conditions for using BPLog (Japanese name: 血圧手帳), an iPhone application (the "App") provided by Yuya Sato ("we," "us," or "our").
- The license to use the App is governed by Apple Inc.'s Licensed Application End User License Agreement (the "Apple Standard EULA"). These Terms supplement the Apple Standard EULA. If these Terms conflict with the Apple Standard EULA, the Apple Standard EULA prevails.
- By downloading or using the App, you agree to these Terms. If you do not agree, please stop using the App and delete it from your device.
- The agreement for use of the App is between you and us. Apple Inc. and its subsidiaries ("Apple") are not parties to these Terms. Apple is, however, a third-party beneficiary of these Terms and may enforce them directly against you.
- In addition to these Terms, the Apple Media Services Terms and Conditions apply to your use of the App.
2. What the App Does and Does Not Do
- The App lets you manually enter readings taken with your own blood pressure monitor, review them in a list and a chart, and export them as a PDF report.
- The App includes the following features:
- Creating, editing, and deleting records containing blood pressure (upper and lower), pulse, date and time, a morning / evening / other category, and a note
- A list organized by date, and averages and a trend chart for a selected period
- A three-level category based on publicly published home blood pressure guidance
- Morning and evening reminder notifications (off by default)
- Exporting and importing backup files (CSV and a dedicated format)
- Creating a PDF report and sharing or printing it (requires the purchase described in Section 6)
- The App does not include the following:
- The App cannot measure blood pressure. An iPhone has no blood pressure sensor.
- There is no account registration, and no feature for sharing information with other users.
- There is no cloud sync. To move your records to a new device, use the backup feature described in Section 4.
- System requirements are as stated on the App Store product page. You are responsible for providing, at your own cost, the device, operating system updates, and network connection needed to use the App.
3. Important Medical Notice
The App is not a medical device. It is not intended to diagnose, treat, or prevent any disease.
- The "Within the general range," "Slightly above the range," and "Above the range" categories shown by the App simply place the numbers you entered into publicly published home blood pressure guidance. They are not a diagnosis and are not medical advice.
- The threshold values used for these categories differ by the App's display language. In Japanese, they are based on the home blood pressure categories in the Japanese Society of Hypertension Guidelines (JSH 2019). In English, they are based on the home blood pressure targets in the ACC/AHA guidelines. You can see the exact values under "About these categories" in Settings.
- If you have any health concerns, if your numbers worry you, or if you are considering changing your medication or lifestyle, always consult a physician or another qualified healthcare professional. Do not act contrary to your physician's instructions because of anything the App displays.
- The readings, averages, charts, and PDF reports in the App are values you measured and entered yourself. We do not warrant their accuracy as measurements taken with a medical device.
- In an emergency, do not use the App. Contact emergency services or a medical facility immediately.
4. Your Records and the Risk of Losing Them
- The records you enter are stored only on your device. We operate no server, and we never receive your records. See our Privacy Policy for details.
- Your records belong to you. We claim no rights of any kind over the records you enter.
- Because your records exist only on your device, they will be lost in the following cases, and we cannot recover lost records.
- You delete the App from your device (your records are deleted with it)
- Loss, theft, failure, or erasure of your device
- A defect in the operating system or in the App
- Please export your records regularly using "Save a backup" in Settings, and keep the files somewhere other than the device itself (cloud storage, email, a computer, and so on). Storing and managing exported files is your responsibility.
- PDF reports and backup files contain the blood pressure values and notes you entered, exactly as entered. Handing them to another person, printing them, or sending them by email is done entirely by your own decision and action. We have no involvement in, and cannot take responsibility for, how a file is handled after you send it. Please check the recipient carefully.
5. Reminder Notifications
- The App can send up to two reminder notifications per day, one in the morning and one in the evening. They are off by default.
- Turning reminders on requires iOS notification permission. If you decline, every other feature remains fully available.
- Reminders are local notifications scheduled on your device. They are not sent from any server of ours. The text is fixed wording and never includes the blood pressure values you recorded.
- A notification may arrive late or not at all if your device is powered off, if a Focus mode is active, or because of the state of the operating system or Apple's implementation. Do not rely on the App's notifications alone for anything affecting your health or safety, such as taking medication or measuring your blood pressure.
- You can turn reminders off at any time using the switches in Settings or through the iOS Settings app.
6. Pricing, Purchase, and Refunds
- The App is free to download. Recording, the list, the chart, and backup are available at no additional cost.
- Only the "PDF report export" feature is paid, through an in-app purchase. It is a one-time, non-consumable purchase. Once you pay, you can keep using it with no further payment.
- The App has no subscriptions. There is no auto-renewing charge and nothing to cancel. The App also displays no advertising of any kind.
- The price is the amount shown on the purchase screen and on the App Store. The amount shown may change based on region, currency exchange, taxes, or limited-time price changes. The amount you actually pay is the amount displayed at the time of purchase.
- Payment is processed by Apple through your Apple Account. We never receive your payment details, such as credit card information.
- If you use the same Apple Account, you can re-enable a purchased feature at no additional cost after changing devices or reinstalling, using "Restore purchase" in Settings or on the PDF export screen. Restoring requires an internet connection and signing in to your Apple Account.
- Apple, not we, decides whether to grant a refund and processes it. We cannot issue refunds. To request a refund, contact Apple through Apple's "Report a Problem" page.
- The in-app purchase in the App is not enabled for Family Sharing.
7. Prohibited Conduct
When using the App, you must not:
- violate any law or public order and morals;
- decompile, disassemble, reverse engineer, or modify the App (except to the extent expressly permitted by law);
- copy, lend, redistribute, or sell the App or any part of it;
- interfere with the operation of the App, or obtain access to paid features by improper means;
- record another person's blood pressure or other health information in the App without that person's consent;
- alter a PDF report or backup file created by the App and present it as genuine; or
- present what the App displays to a third party as if it were a medical diagnosis or medical advice.
8. Disclaimers and Limitation of Liability
- The App is provided "as is." We do not warrant that the App is fit for your particular purpose, that records, calculations, or PDF report contents are free of error, or that the App will be available without interruption.
- To the extent permitted by law, we are not liable for damages arising from your use of, or inability to use, the App. This does not apply where the damage results from our willful misconduct or gross negligence.
- If your use of the App constitutes a consumer contract and the exclusion in the preceding paragraph is held invalid under the Consumer Contract Act of Japan or other applicable law, then, absent willful misconduct or gross negligence on our part, our liability is limited to ordinary damages actually incurred by you and capped at the amount you actually paid for the in-app purchase in the App.
- We, not Apple, are the provider of the App. Apple has no obligation to furnish maintenance, support, or any warranty for the App. Please direct all inquiries, complaints, and claims regarding the App to the contact in Section 10.
- If a third party claims that the App infringes its intellectual property rights, we, not Apple, are responsible for addressing that claim.
- Rights in the App, including its source code, screen design, icons, and text, belong to us or our licensors. As stated in Section 4.2, however, the records you enter belong to you.
9. Changes to the App, Discontinuation, and Changes to These Terms
- We may add, change, or remove features of the App.
- We may discontinue the App. If we do, a copy already installed on your device and the records stored on it do not stop working immediately, but the App may cease to function after future operating system updates. If we decide to discontinue the App, we will give advance notice where reasonably possible, for example on the App Store product page.
- We may change these Terms. Changed Terms apply from the time they are posted on this page. If a change is significant for you, we will note it in the App's release notes or on the App Store product page.
- If you do not agree to the changed Terms, please stop using the App and delete it from your device.
10. Governing Law and Contact
- These Terms are governed by and construed in accordance with the laws of Japan. This does not deprive you of the protection of any mandatory provisions of the law of the country or region where you reside as a consumer.
- The Japanese version of these Terms is the authoritative text. This English version is provided as a reference translation.
