These Terms of Use ("Terms") set out the conditions for using the iPhone application "Meal Memory" (the "App"), provided by Yuya Sato (the "Developer"). These Terms form an agreement between you (the "User") and the Developer.
The license to use the App is governed by Apple Inc.'s Licensed Application End User License Agreement (the "Apple Standard EULA"). These Terms supplement the Apple Standard EULA. If these Terms conflict with the Apple Standard EULA, the Apple Standard EULA prevails.

By downloading the App from the App Store or using it, you are deemed to have agreed to these Terms.
The App lets you record meals with a photo on your device and later practice recalling what you ate. Specifically, it provides the following features:

The App's features do not require an internet connection. Notifications are local notifications that stay entirely on your device. The iOS version required to run the App is stated on the App Store product page.
The App is free to download from the App Store. At no cost, you can save up to 3 meal records and use every feature, including meal quizzes, history, notifications, and switching the display language.
To save a 4th meal record and beyond, you can unlock the limit with a single payment inside the App ("Unlock Unlimited Logs"). This is a one-time purchase: there are no monthly fees and no auto-renewing subscriptions of any kind. If you choose not to unlock, you can still view the records you already saved, answer meal quizzes, and receive notifications.
The price, currency, and applicable taxes are those shown on the App Store at the time of purchase. The Developer may change the price in the future, but will never charge an additional amount to Users who have already purchased the unlock.
All purchases, payment processing, receipts, and refunds are handled by Apple under the Apple Media Services Terms and Conditions. The Developer has no ability to issue refunds. To request a refund, please use Apple's process at https://reportaproblem.apple.com/. Apple decides whether a refund is granted.
Restoring purchases works according to Apple's systems. Using the same Apple Account, you can recover the unlock after changing devices or reinstalling, via "Restore purchase" in Settings or on the unlock screen. Note that the unlock does not support Family Sharing, so it does not carry over to a family member's separate Apple Account.
Only the unlock itself is restored; your recorded data is restored from your device backup (please see Section 5).
You, or the rightful owner, retain all rights to the photos you take or choose and to the answers and notes you type (together, "Your Content"). The Developer claims no rights whatsoever in Your Content.
Your Content is stored only on your device and is never transmitted to any server operated by the Developer. The Developer cannot view Your Content. Your Content is never used to train artificial intelligence or machine learning systems.
You are responsible for holding the rights necessary for Your Content. If you record a photo in which another person appears, or enter information that constitutes another person's personal data, it is your responsibility to obtain that person's consent in advance.
Your records are stored only on your device. If you have device backup turned on, both your photos and your records will carry over to a new device. If you do not back up, your records will be lost.
All of Your Content is stored only on your device. Nothing is synced to any server run by the Developer or to any cloud service the Developer provides.
Both photo files and meal record data (dates and times, meal type, quiz answers, notes, results, and settings) are included in your device backup. If you have iCloud Backup or a computer backup enabled, you can carry them over to a new device when you switch devices or restore an erased device.
Your records will be lost, however, in any of the following cases:
The Developer keeps no copy of Your Content and therefore cannot recover records that are lost. Please check your backup settings before you rely on the App. For records that matter especially to you, we also recommend saving them separately, for example in the Photos app.
In addition, the current version of the App has no feature for deleting or editing individual records. To delete all of your records, delete (uninstall) the App from your device. Doing so removes the photos, records, and settings together.
The App is not a medical device. It is not intended to diagnose, treat, cure, prevent, or mitigate dementia or any other disease or condition, and it does not guarantee any such effect.
The quiz count and accuracy rate shown in the App do not measure, evaluate, or diagnose your memory or your health. Do not use these numbers to judge your own or anyone else's health.
If you have concerns about memory loss or your health, please consult a healthcare professional. Do not delay or avoid seeking care, or disregard a doctor's instructions, because of anything the App shows you.
The App's notifications are local notifications that stay entirely on your device. No internet-based push notifications are used. Notifications require iOS permission, which the App requests the first time you save a meal.
Notifications may arrive late or not at all if your device is powered off, if Low Power Mode or a Focus mode is active, or because of iOS settings, platform behavior, or other circumstances. The Developer does not guarantee that notifications will be delivered.
Do not rely on the App's notifications as reminders for medication, medical appointments, or anything else important to your safety or health.
You can turn notifications off at any time using the switch on the App's Settings screen, or in the iOS Settings app.
When using the App, you must not:
The App is provided "as is." The Developer does not warrant that the App is fit for your particular purpose, that Your Content will be stored completely or permanently, that notifications will be delivered, or that the App is free of defects.
To the extent permitted by applicable law, the Developer is not liable for any damages arising from your use of, or inability to use, the App, including loss or corruption of Your Content, lost profits, and indirect damages.
However, this does not apply where the damages result from the Developer's intentional misconduct or gross negligence. Nothing in this Section limits any rights you have as a consumer under the Japanese Consumer Contract Act or any other mandatory law.
Where the Developer is liable to you (other than for intentional misconduct or gross negligence), that liability is capped, to the extent permitted by applicable law, at the amount you actually paid to purchase the App.
The Developer may change, add, or remove features of the App without prior notice, and may stop distributing the App on the App Store.
If distribution ends, an App already installed on your device will continue to work, but it may become unusable in the future due to iOS updates or other circumstances.
Changes to these Terms: The Developer may revise these Terms as features are added or as laws change. If revised, the updated text and the last-updated date will be posted on this page and on the Terms of Use screen inside the App. If you continue to use the App after the revised Terms are posted, you are deemed to have agreed to them.
Use by minors: If you are a minor, please use the App with the consent of a parent or guardian. Purchases on the App Store are made under the responsibility of the Apple Account holder. The App is not a children's app and is not distributed in the App Store Kids Category.
Governing law: These Terms are governed by and construed in accordance with the laws of Japan. This does not deprive you of the protection afforded to you as a consumer by the mandatory laws of the country or region in which you reside.
