Before & After — Terms of Use
These Terms of Use govern your use of the iOS app "Before & After" (Japanese name: 施工前後; the "App"), provided by Yuya Sato, an individual developer (the "Developer").
The license to use the App is governed by Apple's Licensed Application End User License Agreement ("Apple's Standard EULA"), and these Terms supplement it. If these Terms conflict with Apple's Standard EULA, Apple's Standard EULA controls to the extent of the conflict.
1. Scope and Acceptance
- These Terms apply between the Developer and every person who uses the App ("you").
- By downloading or using the App, you accept these Terms.
- If you are a minor, please use the App with the consent of a parent or guardian.
2. What the App Does
- The App combines two photos you choose from your device's photo library into a single before-and-after comparison image, which you can save to your photo library or share with other apps.
- You can choose how the photos are arranged (side by side or stacked), the finished aspect ratio, the label text placed on the image (such as Before / After), and the position of that text.
- All image processing happens on your device. Your photos and the images you create are never transmitted to the Developer or to any third-party server.
- The App does not include user accounts, sign-in, advertising, push notifications, cloud storage, video editing, blur or mosaic tools, or project management features.
3. Requirements
- The App runs on iPhone and iPad with iOS 17.0 or later. The screen is fixed in portrait orientation.
- An internet connection is required to make or restore an in-app purchase. All other features — choosing photos, composing, saving, and sharing — work offline.
- Operating system updates or changes to device hardware may cause the App to stop working correctly.
4. Pricing, In-App Purchase, and Refunds
- The App is free to download. Composing images, saving them to your photo library, and sharing them are all free to use.
- When used for free, every image you save or share carries a small "Made with Before & After" watermark in the lower-right corner.
- The in-app purchase "Remove Watermark" removes that watermark from images you create after the purchase. This is a one-time, non-consumable purchase. There is no subscription, no recurring billing, no auto-renewal, no free trial, and no consumable purchase of any kind.
- The price is the amount shown in the App Store. It may differ by region, over time, and with currency and promotional changes.
- All purchases and payments are handled by Apple. The Developer does not receive your credit card or other payment details, your Apple Account, your name, or your email address. The only thing the App checks is whether the product has been purchased.
- Your purchase can be restored on another device using the same Apple Account, via "Restore Purchase" on the Settings screen. This purchase is not eligible for Family Sharing.
- Refunds are decided and processed by Apple. The Developer cannot issue refunds. To request one, use Apple's "Report a Problem" page at reportaproblem.apple.com.
- If you are a minor, please obtain the consent of a parent or guardian before making a purchase.
5. Your Photos and the Images You Create
- Copyright and all other rights in the photos you select and in the comparison images you create belong to you or to the rightful owner. The Developer claims no rights in them whatsoever.
- Because your photos and created images are never sent to the Developer, the Developer cannot view, obtain, store, or use them. See the Privacy Policy for details.
- You may use the images you create freely, including for commercial purposes such as flyers, estimates, work reports, websites, and social media — whether or not they carry the watermark.
- You are responsible for securing all rights and permissions needed for the photos you use, including the consent of the owner or client of the property photographed and of any person appearing in the photo.
6. Prohibited Conduct
When using the App, you must not:
- use the App for any purpose that violates applicable law;
- create or use images that infringe the copyright, likeness rights, privacy, reputation, or other rights of any third party;
- create images that misrepresent actual work performed — for example, combining photos from different sites, or presenting a result as the outcome of work that was not actually done — and use them in advertising, sales, or any other context;
- copy, modify, disassemble, decompile, reverse engineer, redistribute, sell, or lease the App; or
- interfere, or attempt to interfere, with the operation of the App.
7. Important Notes About the Images You Create
Images made with this App are meant to be used directly in flyers, reports, and social media. The following points result from how the App is built. Please check them before you use an image.
1. Anything captured in the photo stays in the image
The App has no blur, mosaic, or redaction tools. If your photo shows a nameplate bearing a client's name, personal belongings inside a home, a vehicle license plate, neighboring buildings, or the face of a passerby, all of it remains visible in the finished image. Before publishing or distributing an image, obtain any consent required, or choose a photo that does not capture such details.
2. Some aspect ratios crop your photos
If you choose any ratio other than "Original" (1:1, 4:5, 16:9, or 3:2), part of each photo is cropped to fit the frame. The preview on the editing screen shows the actual result. Please check it before saving.
3. Image quality is lower than the original photo
Photos are downscaled to a maximum of 4096 pixels on the long edge when loaded, and the finished image is exported as a JPEG at 2048 pixels on the long edge with quality 0.9. Keep this in mind if you plan to print the image at a large size.
4. Date, time, and location data are not carried over
The finished image does not retain the Exif metadata of the source photos (capture date and time, location, camera model, and so on). If you need the capture date as a record of the work, keep the original photos separately.
5. Work in progress is not saved
The photos you select and any zoom or position adjustments are held only in the device's memory. They are lost when you quit the App, and you will need to start over. Your layout, ratio, and label settings are restored the next time you open the App.
6. The watermark is removed only from images created after purchase
The in-app purchase applies to images you create after buying it. The watermark on images you have already saved or shared will not disappear. If you need those images without the watermark, create them again after purchasing.
8. Disclaimers and Limitation of Liability
- The App is provided "as is." The Developer does not warrant that the App is fit for any particular purpose or that it will produce the results you expect.
- The Developer does not warrant the appearance or quality of the composed images, or that saving or sharing will always succeed.
- The Developer is not liable for loss of photos or created images resulting from device failure or loss, operating system updates, changes you make in your photo library, or your own mistaken operation. Storing and backing up your photos is your responsibility.
- The Developer is not liable for disputes or damages arising from your provision or publication of created images to third parties.
- Notwithstanding the above, the Developer is relieved of liability only to the extent permitted by applicable law. These disclaimers do not apply where the loss results from the Developer's intentional misconduct or gross negligence.
- Where the Developer is liable (other than for intentional misconduct or gross negligence), the Developer's total liability is limited to the amount you actually paid for in-app purchases in the App.
- Nothing in these Terms limits any rights you have as a consumer that cannot be waived under the mandatory law of your country of residence.
- The App is provided by the Developer, not by Apple. Questions, support requests, and bug reports about the App are handled by the Developer, not by Apple.
9. Changes to and Discontinuation of the App
- The Developer may change the App and may add or remove features.
- The Developer may discontinue the App. In that case, the Developer will endeavor to give notice in advance in the App Store description or on this page.
- After discontinuation, a copy of the App already installed on your device will continue to work for as long as your operating system supports it. However, it may no longer be possible to make or restore in-app purchases.
10. Changes to These Terms
- The Developer may revise these Terms. Revised Terms take effect when posted on this page.
- For changes that materially affect your rights or obligations, the Developer will post the change and its effective date on this page and allow a reasonable period before it takes effect.
- Continuing to use the App after a change takes effect constitutes acceptance of the revised Terms.
11. Survival
Section 5 (Your Photos and the Images You Create), Section 8 (Disclaimers and Limitation of Liability), and Section 12 (Governing Law) survive your discontinuation of use or deletion of the App.
12. Governing Law
- These Terms are governed by and construed in accordance with the laws of Japan.
- The preceding paragraph does not deprive you of the protection of any mandatory consumer law of the country or region in which you reside.
