ShapeLapse Terms of Use

These Terms of Use (these "Terms") set out the conditions for using the iOS app "ShapeLapse" (the "App"), provided by Yuya Sato (the "Operator"). By downloading or using the App, you agree to these Terms.
Article 1 (Scope; Relationship to Apple's Standard Agreement)
- The license to use the App is governed by Apple's Licensed Application End User License Agreement (the "Standard EULA").
- These Terms supplement the Standard EULA. If these Terms conflict with the Standard EULA, the Standard EULA prevails with respect to license matters.
- These Terms are an agreement between you and the Operator, not with Apple. The Operator, not Apple, is responsible for providing and supporting the App. Apple and its subsidiaries are third-party beneficiaries of these Terms to the extent set out in the Standard EULA.
Article 2 (What the App Does)
- The App automatically detects body positions (shoulders and hips) in photos you take or select, aligns the photos, and creates a timelapse video of your body's changes.
- All photo analysis (body detection and alignment) and video creation happen entirely on your iPhone. Your photos and videos are never sent to the Operator or to any external server.
- The App's camera includes a shooting guide that overlays your previous photo semi-transparently. How that photo is handled is described in Article 5, Section 2.
- Creating and previewing videos is free.
Article 3 (Fees, Purchases, and Refunds)
- Saving and sharing the videos you create requires a single one-time payment (a non-recurring in-app purchase). It is not a subscription, and you will never be charged repeatedly or automatically.
- The price is the amount shown on the App Store and on the in-app purchase screen. Prices may change without notice (purchasers will never be asked to pay again).
- Payments are processed by Apple. Refunds are also decided by Apple under Apple's policies, so the Operator cannot process refunds directly. To request a refund, use Apple's Report a Problem page.
- After switching devices or reinstalling, you can restore your purchase free of charge with "Restore purchase" in the App, using the same Apple Account.
- This purchase is not eligible for Family Sharing.
Article 4 (Rights and Responsibilities for Photos and Videos)
- The rights to the photos you use in the App and to the videos you create belong to you (or to their original rights holders). The Operator claims no rights to them.
- The Operator never receives your photos or videos and has no way to view them.
- If your photos include people other than yourself, you are responsible for respecting their likeness and privacy and for obtaining any necessary consent.
- Body photos are particularly privacy-sensitive. Whether to share or publish a video you created — on social media or elsewhere — and with whom, is your own decision and responsibility. Please note that if "Show capture date" is on, the capture date of each photo appears in the video itself (this can be turned off).
- Any action that sends a video off your device via the share feature is taken at your own discretion and responsibility.
- The BGM tracks bundled with the App (Iron Rage, EVOLUTION BEAT, and Flex Glow) are copyrighted by the Operator. As part of the videos you create with the App, you may save, share, and publish videos that include these tracks (including posting to social media) free of charge. However, the tracks may not be extracted from a video or used or distributed on their own.
Article 5 (Data Retention and App-Specific Notes)
- The App does not store your working data (selected photos, body selections, or unsaved videos) on your device. This data is lost when you close the App (unsaved temporary videos are automatically deleted the next time the App launches). To keep a video, save it to your photo library.
- For the shooting guide, a downscaled copy of the single most recent photo you took or imported is stored in the App's private area on your device. It is overwritten each time you take or import a new photo, and it is erased when you delete the App. It is never sent off your device.
- Photos taken with the App's camera are saved to your device's photo library. You can manage or delete them in the iOS Photos app.
- You are responsible for managing and backing up your saved photos and videos.
- Body detection and alignment are automatic processes and can make mistakes (a body may not be detected, the wrong person may be selected, or the alignment may be off). For photos that can't be detected, you can adjust the position manually or exclude them. Please check the result in the preview before using it.
- The App may automatically sort photos by their capture date recorded in the photo (Exif data). Photos without a capture date remain in the order you selected them, placed at the end.
Article 6 (Prohibited Conduct)
When using the App, you must not:
- violate laws, regulations, or public order and morals;
- infringe the copyright, likeness rights, privacy, or other rights of others (including using or publishing photos without the necessary rights or consent);
- copy, modify, reverse engineer, or redistribute the App (except as permitted under the Standard EULA); or
- interfere with the operation of the App or other users' use of it.
Article 7 (Disclaimer)
- The App is provided "as is." The Operator does not warrant that it will be complete, accurate, or fit for any particular purpose.
- The App is a tool for recording and visualizing changes in your body's appearance. It does not provide medical or health advice.
- To the extent permitted by law, the Operator is not liable for damages arising from your use of, or inability to use, the App — except where the damage is caused by the Operator's willful misconduct or gross negligence.
- Nothing in these Terms limits any rights guaranteed to you as a consumer under the Consumer Contract Act of Japan or other applicable laws.
Article 8 (Changes to the App; Changes to these Terms)
- The Operator may change the App or discontinue it without prior notice.
- The Operator may revise these Terms when necessary. Revised Terms take effect when posted on this page (or on the effective date stated at the time of posting). For material changes, the Operator will provide clear notice in the App or in the App Store update notes.
- By continuing to use the App after a revision, you agree to the revised Terms.
Article 9 (Governing Law)
These Terms are governed by and construed in accordance with the laws of Japan. This does not deprive you of any consumer rights you are entitled to under the laws of the country or region where you live.
