この利用規約(以下「本規約」)は、佐藤祐也(以下「当方」)が提供するiPhoneアプリ「ふとボイス」(以下「本アプリ」)の利用条件を定めるものです。本アプリを購入またはご利用になった時点で、本規約に同意いただいたものとみなします。

第1条(Appleの使用許諾契約との関係)

  1. 本アプリを使用できる範囲(ライセンス)については、Appleが定める標準の使用許諾契約(Licensed Application End User License Agreement)が適用されます。本規約は、これを補足するものです。
  2. 本規約とAppleの標準使用許諾契約の内容が矛盾する場合は、Appleの標準使用許諾契約が優先します。
  3. 本規約は、利用者と当方との間の契約です。Appleは本規約の当事者ではありません。Appleは本アプリの内容・動作について責任を負わず、本アプリに関するサポートを提供する義務も負いません。ただしAppleおよびその子会社は、本規約の第三者受益者として、本規約を利用者に対して直接行使することができます。
  4. 本アプリの入手と利用には、Apple Media Services利用規約その他App Storeの条件も適用されます。

第2条(本アプリの内容)

  1. 本アプリは、話した言葉をiOSの音声認識で文字に変え、メモ(ふせん)としてお使いのiPhoneの中に保存するアプリです。文字はキーボードで書き直すこともできます。
  2. 本アプリは、開いた時点で自動的に録音と聞き取りを始めます。これは、思いついたことをすぐ残せるようにするための仕組みです。録音の前に、iOSがマイクと音声認識の使用許可を確認します。許可しない場合、または画面の「やめる」を押した場合、メモは作られません。
  3. メモが当方のサーバーに送信されることはありません。当方はサーバーを持っておらず、利用者のメモを見ることはできません。
  4. 本アプリにアカウント登録やログインはありません。他の利用者に内容が公開されることもありません。

第3条(必要な環境)

本アプリはiOS 17.0以降のiPhoneでご利用いただけます。端末内での音声認識に対応していない端末や言語では、文字に変えるためにインターネット接続が必要になることがあります(第5条)。

第4条(料金・購入・返金)

  1. 本アプリは買い切り型の有料アプリです。購入後に追加の支払いは発生しません。アプリ内課金、月額課金(サブスクリプション)、広告はありません。
  2. 価格は、App Storeに表示されている金額です。価格は、セール、為替、国や地域、時期によって変わることがあります。
  3. 購入・支払い・返金・購入の復元(ファミリー共有を含む)は、すべてAppleのApp Storeの仕組みと規約に従って行われます。
  4. 当方は返金の手続きを行うことができません。返金をご希望の場合は、Appleの窓口(reportaproblem.apple.com)からお申し込みください。

第5条(音声認識について)

  1. 本アプリの文字変換には、Appleが提供するiOSの音声認識機能を使用します。
  2. お使いの端末と言語が端末内での音声認識に対応している場合、音声は端末の中だけで文字に変換され、外部には送信されません。
  3. 対応していない場合は、文字に変換するために音声データがAppleのサーバーに送られることがあります。この場合の取り扱いはAppleのプライバシーポリシーに従います。詳しくはプライバシーポリシーをご覧ください。
  4. 聞き取りの精度は、周囲の騒音、話し方、端末の状態、通信の状況などにより変わります。当方は変換結果の正確さを保証しません。変換された文字は、必ずご自身で確認してください。
  5. 本アプリの変換結果は、医療、法律、金融その他の専門的な助言ではありません。また、正確な記録が求められる用途(契約の証拠、業務上の正式な記録、緊急時の連絡など)には使用しないでください。

第6条(メモの保存とデータの消失について)

  1. メモは新しいものから最大100件まで保存されます。101件目を保存すると、いちばん古いメモが自動的に消えます。この動作は取り消せません。
  2. メモは端末内にのみ保存されます。そのため、本アプリの削除、端末の故障・紛失・初期化、iOSやアプリの更新などにより、メモが失われることがあります。
  3. 当方はサーバーにメモを預かっていないため、失われたメモを復元することはできません。大切な内容は、紙に書き写すなど別の方法でも控えを残してください。
  4. 当方は品質の向上に努めますが、本アプリの不具合(バグ)その他の原因によりメモその他のデータが失われたり壊れたりした場合、法令上許される範囲で、その責任を負いません。ただし、当方に故意または重大な過失があるときは、この限りではありません。

第7条(利用者が作ったメモの権利と責任)

  1. 利用者が本アプリで作成したメモの内容に関する権利は、利用者に帰属します。当方はこれについて一切の権利を主張しません。
  2. 他人の発言を録音して文字にする場合や、他人の個人情報・秘密を含む内容を吹き込む場合は、必要な同意を得るなど、利用者ご自身の責任でご対応ください。

第8条(禁止事項)

本アプリの利用にあたり、次の行為を禁止します。

  1. 法令に違反する行為、または犯罪に関わる行為
  2. 他人の権利(著作権、プライバシー、肖像権など)を侵害する行為
  3. 本アプリの複製、改変、リバースエンジニアリング、再配布、有償での譲渡・貸与
  4. 本アプリの正常な動作を妨害する行為

第9条(知的財産権)

本アプリのプログラム、画面デザイン、アイコン、文章その他のコンテンツに関する権利は、当方または正当な権利者に帰属します。第7条のとおり、利用者が作成したメモはこれに含まれません。

第10条(免責・責任の上限)

  1. 本アプリは現状のまま提供されます。当方は、本アプリに不具合や中断がないこと、および特定の目的に適合することを保証しません。
  2. 本アプリの利用に関連して利用者に損害が生じた場合、当方の賠償責任は、利用者が本アプリの購入時に実際に支払った金額を上限とします。
  3. 前2項および第6条4項は、当方に故意または重大な過失がある場合には適用されません。また、これらの条項は、消費者契約法その他の法令により当方が負うべき責任を制限するものではありません。

第11条(提供の変更・終了)

当方は、本アプリの機能を変更・追加・削除すること、および本アプリの提供を終了することがあります。提供を終了した場合でも、すでに端末に保存されたメモは端末内に残ります。ただし、iOSの更新などにより本アプリが動作しなくなることがあります。

第12条(規約の変更)

  1. 当方は、必要に応じて本規約を変更することがあります。
  2. 変更後の規約は、本アプリ内またはこのページに掲載した時点で効力を生じます。利用者に大きな不利益となる変更を行う場合は、掲載にあたってその内容が分かるように示します。

第13条(準拠法)

本規約は日本法に従って解釈されます。ただし本規約は、利用者がお住まいの国や地域の法律により消費者として認められる権利を制限するものではありません。

Terms of Use

These Terms of Use (the "Terms") set out the conditions for using the iPhone app "FutoVoice" (the "App") provided by Yuya Sato (the "Developer"). By purchasing or using the App, you are deemed to have agreed to these Terms.

Article 1 (Relationship to Apple's License Agreement)

  1. The scope of your license to use the App is governed by Apple's standard Licensed Application End User License Agreement. These Terms supplement that agreement.
  2. If these Terms conflict with Apple's standard Licensed Application End User License Agreement, that agreement prevails.
  3. These Terms are an agreement between you and the Developer only. Apple is not a party to these Terms. Apple is not responsible for the App or its content, and has no obligation to furnish any maintenance or support for the App. However, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them directly against you.
  4. Your acquisition and use of the App is also subject to the Apple Media Services Terms and Conditions and other App Store terms.

Article 2 (What the App Does)

  1. The App converts your spoken words into text using the speech recognition built into iOS and saves the text as sticky notes on your iPhone. You can also edit the text with the keyboard.
  2. The App begins recording and listening automatically the moment you open it. This is by design, so that you can capture a thought immediately. Before recording, iOS asks for your permission to use the microphone and speech recognition. If you do not grant permission, or if you tap "Cancel" on screen, no note is created.
  3. Your notes are never sent to a server operated by the Developer. The Developer operates no server and cannot see your notes.
  4. The App has no account registration and no sign-in. Your notes are never shown to other users.

Article 3 (Requirements)

The App runs on iPhone with iOS 17.0 or later. On devices or languages that do not support on-device speech recognition, an internet connection may be required to convert speech into text (see Article 5).

Article 4 (Price, Purchase, and Refunds)

  1. The App is a one-time paid purchase. No further payment is required after purchase. There are no in-app purchases, no subscriptions, and no advertising.
  2. The price is the amount shown on the App Store. Prices may change due to promotions, currency exchange rates, your country or region, and timing.
  3. All purchases, payments, refunds, and purchase restoration (including Family Sharing) are handled under Apple's App Store systems and terms.
  4. The Developer cannot process refunds. If you would like a refund, please request it from Apple at reportaproblem.apple.com.

Article 5 (Speech Recognition)

  1. The App uses Apple's speech recognition built into iOS to convert speech into text.
  2. If your device and language support on-device speech recognition, your speech is converted to text entirely on the device and is not sent anywhere.
  3. If on-device recognition is not supported, audio data may be sent to Apple's servers to be converted into text. In that case, Apple's Privacy Policy governs how the audio is handled. See the Privacy Policy for details.
  4. Accuracy varies depending on background noise, how you speak, the condition of your device, and network conditions. The Developer does not guarantee the accuracy of the results. Always check the converted text yourself.
  5. The results are not medical, legal, financial, or any other form of professional advice. Do not rely on the App where an accurate record is required, such as contractual evidence, official business records, or emergency communication.

Article 6 (Note Storage and Data Loss)

  1. The App keeps up to 100 of your most recent notes. When you save a 101st note, the oldest note is deleted automatically. This cannot be undone.
  2. Notes are stored only on your device. They may therefore be lost if you delete the App, or if your device is damaged, lost, reset, or affected by an iOS or app update.
  3. Because the Developer holds no copy of your notes on any server, lost notes cannot be recovered. Please keep a separate copy of anything important, for example by writing it down on paper.
  4. While the Developer strives to maintain quality, the Developer disclaims liability, to the fullest extent permitted by law, for the loss of or damage to notes or any other data caused by defects (bugs) in the App or by any other cause. This does not apply where the loss results from the Developer's willful misconduct or gross negligence.

Article 7 (Your Notes: Rights and Responsibility)

  1. All rights in the content of the notes you create with the App belong to you. The Developer claims no rights in them whatsoever.
  2. If you record another person's speech, or dictate content containing another person's personal information or confidential information, it is your responsibility to obtain any necessary consent.

Article 8 (Prohibited Conduct)

The following are prohibited when using the App:

  1. Conduct that violates applicable law, or that is connected to criminal activity
  2. Infringing the rights of others, including copyright, privacy, and rights of likeness
  3. Copying, modifying, reverse engineering, redistributing, selling, or lending the App
  4. Interfering with the normal operation of the App

Article 9 (Intellectual Property)

All rights in the App's program code, screen design, icons, text, and other content belong to the Developer or the respective rights holders. As stated in Article 7, this does not include the notes you create.

Article 10 (Disclaimer and Limitation of Liability)

  1. The App is provided as is. The Developer does not warrant that the App will be free of defects or interruptions, or that it will be fit for any particular purpose.
  2. If you suffer damage in connection with your use of the App, the Developer's liability is limited to the amount you actually paid to purchase the App.
  3. Paragraphs 1 and 2 above and Article 6, paragraph 4 do not apply where the Developer has acted with willful misconduct or gross negligence. Nor do those provisions limit any liability the Developer bears under the Consumer Contract Act of Japan or any other applicable law.

Article 11 (Changes to, and Discontinuation of, the App)

The Developer may change, add to, or remove features of the App, and may discontinue the App. If the App is discontinued, notes already saved on your device remain on your device, although the App may stop working after an iOS update.

Article 12 (Changes to These Terms)

  1. The Developer may amend these Terms when necessary.
  2. Amended Terms take effect when posted in the App or on this page. Where an amendment is significantly disadvantageous to users, the Developer will make its substance clear when posting it.

Article 13 (Governing Law)

These Terms are governed by and construed in accordance with the laws of Japan. These Terms do not, however, limit any rights you have as a consumer under the mandatory law of your country or region of residence.
